It shall be unlawful for any person to keep, harbor, maintain or permit upon property under his control and within the City of Sylvia, Kansas, any livestock or fowl, except as provided in this article.

Any person may apply to the City of Sylvia, Kansas, for a permit to keep, maintain or harbor livestock and/or fowl within the City of Sylvia, Kansas. Such application shall state that the proposed location and boundaries of any pen or enclosure for such livestock and/or fowl and must have at least two-thirds in numbers of adjoining property owner’s permission. The City of Sylvia, Kansas, may refuse to grant such permits unless the applicant has demonstrated that such livestock and/or fowl will be kept, maintained or harbored in adequate pens or enclosures and kept, maintained or harbored a sufficient distance from adjoining property, and such livestock or fowl will be kept or harbored in such a manner as to prevent them from becoming offensive to any person in that vicinity or otherwise annoying to the public. Such permit may be revoked by the City of Sylvia, Kansas at any time that the permit holder shall keep, maintain or harbor livestock and/or fowl except as stated in his permit, or shall keep, maintain or harbor livestock and/or fowl in any offensive manner. The cost of such permit shall be Twenty Dollars ($20.00) for each location per year.
(a) The City of Sylvia, Kansas shall not issue any permits, unless adequate space and/or there is adequate supplemental feed maintained for each livestock and/or fowl, which, shall be not less than one-fourth acre for each sheep or goat, and not less than one acre for each horse or cow; in no event, shall a permit be issued to any owner or occupant for more than four livestock. Fowl must have adequate space for number of birds.
(b) If at any time after the permit has been issued, it is determined that a problem with health and/or sanitation exists due to the maintenance of such livestock and/or fowl, that a condition of mistreatment of the livestock and/or fowl exists, or that the presence or maintenance of such livestock and/or fowl is creating a nuisance or the livestock and/or fowl are otherwise being maintained in violation of the restrictions and limitation of this article, the City of Sylvia may withdraw the permit and the livestock and/or fowl shall be promptly removed.
(c) For any permit issued, the City of Sylvia, Kansas shall charge a permit fee of $20.00 (Twenty Dollars) per calendar year or any portion thereof. The permit will be issued for a single location, no more than one permit per location.
(d) Nothing stated within this article or implied therefrom, shall exempt persons from complying with all provisions of this article and all applicable City, County and State health sanitation and zoning laws.
(e) Livestock permitted shall be limited to cattle, sheep, goats and horses; no swine or other livestock shall be permitted within the City of Sylvia, Kansas.

A person who presently keeps, maintains, or harbor or permits livestock and/or fowl within the City of Sylvia, Kansas, shall apply for a permit to continue to keep, maintain, or harbor such livestock and/or fowl within the City of Sylvia as provided by this article. If such permit is denied, then such person keeping, maintaining, harboring or permitting livestock and/or fowl on his/her property shall be granted ten (10) days from and after the receipt of notice of such denial of permit, in which to remove such livestock and/or fowl from the City of Sylvia, Kansas. All permits issued under Ordinance No. 274A shall be renewed once per year for $20.00 (Twenty Dollars) on the first of January until December 31 of each year.

Any person violating Section 2-201, upon conviction thereof, shall be subject to a fine of not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00) and cost of court fees in the amount of $94.50.

In construction of this article, the following definition and rules shall apply:
(a) Livestock and/or fowl shall include but shall not be limited to the following: cattle, horses, goats, chickens, doves, pigeons, geese and all other animals, fowl or birds, except cats and dogs, commonly included with the definition of those terms. Except for pigs. No swine will be allowed in the City of Sylvia.
(b) Person shall include a firm, partnership, association of persons, corporation, organization or any other group, as well as an individual.
(c) Gender words importing the masculine gender shall also include feminine and neuter.
(d) Offensive shall include any condition which offends the sense of sight, smell or hearing as well as those which might be injurious to public health, safety or welfare.
(e) Property under control shall be presumed of any owner or occupant of such property.
